1. Acceptable Use

By using Gertrude, you agree to:

• Use the service for lawful purposes only.
• Not use the service for illegal or harmful purposes, including harassment or hate speech.
• Acknowledge that AI companions are not real people and their statements are AI-generated.
• Confirm you are 18 years of age or older.

2. Accounts and Authentication

Our account authentication uses a secure Authorization Header or Secure Cookie. You are responsible for keeping your account credentials confidential.

3. Payments and Subscriptions

Purchases of credits and subscriptions are final and non-refundable, except as required by law. Subscriptions are managed via Stripe's customer portal, accessible from your account settings.

Note for EU/UK Consumers: You have a legal right to withdraw from waitlist or subscription contracts within 14 days without giving any reason. However, you explicitly agree that we begin the performance of the service before the end of the withdrawal period, and you acknowledge that you thereby lose your right of withdrawal once the service has been fully performed (e.g., credits spent).

4. AI Characters & Content

Our website features AI characters. We do not currently generate NSFW videos or images. Explicit content is restricted to text-based interaction only.

5. Limitation of Liability

Gertrude is provided "as is" and "as available." We are not liable for any content generated by the AI characters or for any damages resulting from your use of the service. You use the service at your own risk.

6. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany, provided that you are a business customer or do not have a general place of jurisdiction in Germany.
